GENERAL TERMS AND CONDITIONS

Speciale Immobilien Sagal (also known as Speciale Home) will be happy to organize a relaxing stay for you. To ensure your satisfaction, please carefully read the following Terms and Conditions, which form part of the Contract. Thank you for your time and understanding.

CONTRACT

For the stipulation of the contract, the provisions of the Code of Obligations apply. As a rule, the contract ends with a booking confirmation or the unconditional acceptance of a hotel offer by the guest.

The customer's general terms and conditions apply only if expressly agreed in advance in writing.

If the guest requests services that are not provided by Speciale Home itself, it will only act as an intermediary. These services will be billed separately.

RATES, DEPOSIT, INVOICING

The prices result from the signing of the contract (booking confirmation) excluding the tourist tax.

Depending on the size of the reservation, the guest is required to make a prepayment or credit card guarantee. If a deposit is agreed, this must be paid within the agreed deadline, otherwise Speciale Home can freely use the apartments.

Unless otherwise agreed, the bill must be paid by the guest at the latest upon departure. As means of payment, the hotel accepts cash, credit cards (Mastercard, VISA and American Express), debit cards (Maestro-Card, V- Pay and Postcard).

Invoices without a due date are payable within 10 days of the invoice date without deductions. La Speciale Home has the right to invoice accrued credits at any time and to demand immediate payment. In case of late payment, you have the right to charge the applicable legal default interest at the rate of 5% of the total invoice amount. La Speciale Home reserves the right to demonstrate greater damages.

The agreed prices include value added tax and taxes required by law. La Speciale Home reserves the right to adjust the agreed prices due to changes in legal tax rates.

CANCELLATION POLICY

Those foreseen and communicated at the time of booking will be applied

La Speciale Home reserves the right to individually modify the cancellation conditions depending on the size of the booking; This will be noted in the confirmation (contract). A cancellation/change to the cancellation terms by the guest is only possible with the written consent of Speciale Home.

Cancellation by Speciale Immobilien

The apartments can only be used for accommodation. La Speciale Home has the right to withdraw from the contract without notice and without further notice if the contract has been entered into on the basis of false or misleading information or if the apartment is not used in accordance with the contract.

If the agreed advance payment is not made even after the expiry of a reasonable grace period established by Speciale Home, Speciale Home has the right to withdraw from the contract.

Furthermore, Speciale Home has the right to withdraw from the contract on an extraordinary basis for justified factual reasons, for example if - force majeure or other circumstances beyond the control of the Company which make the fulfillment of the contract impossible.

In case of justified withdrawal by Speciale Home, the customer is not entitled to compensation.

If Speciale Home is unable to fulfill its service obligations due to overbooking, it must offer the guest an equivalent substitute apartment.

Apartments

The apartments are available from 4pm until 8pm and are available to guests until 11am on the day of departure. In case of early arrival or late departure, the apartment can be occupied earlier or left later in agreement with the Home Special. If the apartment is occupied by the guest for a longer period of time without prior consultation, Speciale Home may charge 50% of the indicated apartment rate up to 6:00 pm and 100% after 6:00 pm.

LIABILITY

La Speciale Home is responsible for guests' personal effects in accordance with the provisions of the law. Liability for slight negligence is expressly excluded.

La Speciale Home assumes no responsibility for services provided by subcontractors within the apartments

In the event that the guest suffers damage or is not satisfied with the Speciale Home's services, he or she must report it immediately, otherwise he or she will no longer be able to assert any rights.

All claims against Speciale Home are generally subject to a limitation period of 6 months after departure, unless mandatory legal provisions provide for longer periods.

FINAL PROVISIONS

Changes or additions to the contract or booking confirmation are always made in writing, if possible. Unilateral changes or additions are invalid.

With the booking confirmation or the unilateral confirmation of a booking by the customer, the customer accepts the "General Terms and Conditions".

This contract is subject exclusively to Swiss law.

The parties agree that the exclusive jurisdiction will be that of Celerina/St. Moritz in Switzerland.
